Terms and Conditions for Digital Photo Sales

Overview

These Terms and Conditions ("Terms") govern the purchase and use of digital photo files made available through this website. By purchasing and downloading any digital file, you agree to be bound by these Terms.

License Grant

Upon successful purchase, you are granted a non-exclusive, worldwide, perpetual, royalty-free license to use the purchased digital file for both commercial and non-commercial purposes. Permitted uses include, but are not limited to, use in advertising, websites, social media, presentations, print materials, and other creative or editorial projects. This is a license only. No ownership or copyright is transferred.

Restrictions

• Resell, sublicense, share, or redistribute the original file or any substantially similar version of it, whether free or for sale.
• Offer the file on stock marketplaces, image libraries, template platforms, or similar services.
• Claim authorship of the image or register it as a logo, trademark, or service mark.
• Use the image in any unlawful, defamatory, misleading, or harmful context.
• Use the image in a way that implies endorsement by the photographer or any depicted subject, unless explicitly agreed in writing.

Editorial use may require appropriate context, captions, or disclosures where required by law.

Attribution

Attribution is appreciated but not required. If you choose to credit the author, please use: "Photo by Wojtek Andrzejczak".

Delivery and Downloads

• After purchase, you will receive a secure download link associated with your order.
• Download links are valid for 30 days and allow up to 3 downloads per order.
• If you experience technical issues with downloads or access, please contact support within the download period.

Invoices and Tax

• An invoice will be automatically generated and emailed with your download link.
• VAT (Value Added Tax) is included in the price based on your country of residence.
• Switzerland customers: 7.7% VAT is charged and will be displayed on your invoice.
• EU customers: VAT applicable in your country is charged (rates vary by country).
• International customers (non-EU): No VAT is charged on digital goods.
• All prices shown are exclusive of VAT (net prices). Total amount including VAT will be calculated at checkout.
• Invoices are valid proof of purchase and can be used for business/tax purposes.

Refunds

Digital files are considered digital goods. All sales are final. Refunds may be granted only in the following cases:

• Duplicate purchase of the same file.
• Technical failure that prevents file delivery and cannot be resolved.
• The delivered file is materially different from the product description.

Refund requests must be submitted within 14 days of purchase.

Ownership and Derivative Works

All copyrights and intellectual property rights remain with the photographer. You may modify the image and create derivative works for your own projects. You may not distribute, resell, or make available the original file or derivatives in a manner that allows third parties to extract or reuse the image as a standalone asset.

Liability and Warranty

All files are provided "as is". To the maximum extent permitted by law, the photographer makes no warranties, express or implied, and shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the files.

Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Zurich, Switzerland.
